Teraflex Hinged Tire Carrier work with new wheels setup?

I was just sent an email back by Teraflex saying that I cannot run my wheels & tires with that 5.7 backspace without getting the adjustable mount and a 1.25" wheel spacer. I was hoping to just run the hinged carrier with the stock tire mount.

I have the stock rims so the backspacing is no good for a 35" tire, hence the spacer. It brings it out and up away from the 3rd brake light housing and bumper.
