You might be able to... The "old" mounting location is still on the bracket and is used as a datum when they manufacture it. (Note their older brackets didn't raise the mount as high.) I think you will need to remove some material at the bottom of the opening for the bar to have clearance. Shown below....

What bracket do you go with? I netted exactly 2.5" of lift, so I don't think I need a bracket nearly that tall.
Do they change the bracket for their different size springs?? I just want to bolt this kit on and not have to worry about all the other things it sounds like can be issues. I don't want to use a drag link flip kit or add anymore things to this already expensive kit. I hate having to add a new DS, but will do it if necessary. Being at $3200 with a new DS is all I want to spend and more than I really wanted to spend.

They are working on a 1" lower rear bracket for the 2.5" kits, but my opinion is that is still too tall. At the moment, all kits ship with the tall rear bracket. I have not done a d-link flip and front track bar raise and don't plan to... The front end still does just fine and an adjustable front track bar will let you recenter the axle. Since you have a 3.6L you WILL need a new front shaft in short order, even with the 2.5" kit so plan on it.

You can also see if you can use exhaust spacers. The lift height isn't an issue, it's how far the axle can drop. If you don't have a skid plate issue, use the Rancho fix which provides a lot more room for the drive shaft to drop. And as Dirtman said, if it is still too close, use a limiting strap on the diff. You really don't have to get a new drive shaft. It's an all around good idea if you wheel a lot and play in the rocks, but if that's not what you're doing then not a huge deal. Aftermarket shafts can handle a bit more angle, but it's not a ton. Someone will have to confirm, but I think the stock shaft can handle 40 degrees and a 1310 can go to 45 degrees?

Every kit has compromises. I think MC does a good job limiting them. There are so many variations of Jeeps and use cases. It's ultimately up to the end user to make final adjustments for their unique application.

Customer service is excellent. If you get a 2.5" lift and sense the rear track bar bracket is causing an issue, I'd be surprised if they didn't work with you to fix it.

I agree with this... and to me fair to MC, I have not called to tell them that the bracket was the cause of my issue yet. I do plan to do so though as both the bracket and rear track bar are no longer of use to me. If I had swapped the bracket for my original purposes I would expect to eat the replacement bracket. But since I swapped to correct a handling issue I think they should help me absorb the cost(s).

If i recall 1310 is less than that. ..like 30 degrees. 1410 is ballpark there.

Yep, you're right. 28* for a 1310 and 32* for a 1350. However, it's not recommended to run them to that angle. Didn't look up 1410.

not to derail, but a 1350 should be less than a 1310.

That's what I thought. I got my info from four wheeler magazine. Assumed it was a reliable source, but apparently not.
