That is bull shit. If i am not mistaken they even went as far as changing the boot or skid plate next to it on '08 so this problem doesn't happen. More than likely the boot ripped when the clamp hit the skid plate while flexed.

They must be able to prove what caused the failure in order to deny you a warranty claim.

If they still refuse you have three options with them:

1. Litigation
2. Try a different dealer
3. Bite the bullet and pay

I would try another dealer first and if they don't cover it then i would tell them they will be hearing from your lawyer. The law is really pretty clear on these matters.

Thanks for the advice! Does anybody have a picture of the front drive shaft boot area on an 08 4dr Automatic?
