Regardless of what we think of the tow ratings, they are what they are. Only way to stay out of trouble with the legal system is to stay inside the limits.
We don't worry about a lot of legal stuff like fenders or mud flaps. But all the legal system will hand you for too little tire coverage is a citation. If the worst happens while towing over the limit, good luck with your net worth. Doesn't even matter if the accident was somebody else's fault.

I go thru this very convo almost everyday at work. My boss loves to over load trucks. I know less trips equals more time saved but at what cost? Extra Repairs and wear and tear on the trucks doesn't make sense to me. Plus as stated, the risks aren't worth the rewards. Max payload (hauling or towing) is there for a reason. Sure the trucks could pull more but why stress the suspension, brakes, and driveline. So my advice would be don't tow more than the JK is rated for. Your trailer could push you thru intersections or pull you wide thru turns into oncoming traffic.
