All depends on the look u want I suppose. Are you going to put after market suspension, wheels, and tires on it? If so, you might find silver to be easier than black to coordinate wheel colors. But that's just me. I'm kinda picky like that.

Too much
Here's my analysis. On November 4, I paid $30,445 for a 2009 fully loaded 4 dr Rubi (incl. nav, dual tops, etc.). The MSRP was about $36,585. A leftover NEW 2008 Rubi equipped the same way is worth about $3000 less than an '09 due to the model year change or about $27,445. Without nav, subtract another $1200 which gets your used Rubi down to $26,245. After that, a used 2008 Rubi like the one you're looking at is worth about 10% less than a new one (in your case, $2625 less). In other words, $23,620 is the MAX you should pay for a used 2008 Rubi without nav (assuming it's in mint condition).

Don't do it. The deals are out there. You just have to look for them. 3 weeks ago I purchased my 4 door dual top Rubicon that is fully loaded without the MyGig. The sticker on it was just over $35,100 and I got them to toss in a mopar hitch and remote start. I ended up getting it for 27,800 otd. Some dealers are just hurtin right now. Good Luck!
