By the looks of it, the tree bounced once before he hit it, which helped make it more of a glancing blow. He's damn lucky to be alive.

So what if he got it on video?? He still should have stopped and called the cops! with the road conditions what they appear, someone else could have hit it and gotten messed up, if he would have stopped, he could warn others until the cops got there...
