Legal status? Lmao off! What would the persons legal status have to do with the accident?
Originally from Texas, twice involved in fender Benders where the other driver had no insurance...the Department of Public Safety pulled his DL until he made restitution, that was about 20 years ago, not sure if that is still in effect. Would be nice if you had that option in your state.

3) So what's with all those less than stellar side impact tests on the JK? Looks to me like it held up pretty damn good given the circumstances of this accident

WOW!!!! That's brutal... First and foremost thank God you're ok !!!!!!! and I sure hope not a penny has to come out of your pocket for the replacement. Once again good to know you're ok.

You walked from it that is the most important thing -- just to bad it wasn't on the test drive it happened instead of after you took possession of it. Once box I have always checked off when purchasing insurance is 'uninsured motorist' for this very reason. Living in CA, I'd bet we have more uninsured illegals rolling our freeways than we can ever imaging.

Damn! Glad you are ok. Get a judgment against him for greater than what your insurance pays out (they have subrogation rights). In most states you can renew judgments every seven years indefinitely (unless he files BK). He may not be able to pay now...but you can certainly make him pay later.
