My thoughts as well.
IMO, 40" tires on a road-going 2-door JK is a bad idea on any number of levels:

No such laws in GA.
This kid reminds me of the kids we had come in our Jeeps store in Roswell, GA (not far from Forsyth). It always blew my mind seeing them tell their parent what they wanted and the parents bought it for them. Some sweet package Jeeps too.

Georgia's lift/lower law states that the factory suspension can not be modified more than 2" up or down.
And Forsyth, Ga is a couple of hours from Fortec. Your thinking of Forsyth county which is close to fortec.

Is that some sort of brace holding the xenon flares up in place to help hold their shape or is it something that I obviously don't know anything about?
I'm only asking this because my set of xenon flares on the front droop down like crazy towards the tires and have a warped sort of look to them and my set are the only ones I've seen to look like this. I really don't like it!

The OP was very gung ho about getting 40s, and 37s being lame because all his friends had them, and his folks were picking up the tab for everything, so let's see a pic of the 40s on his JK. lol

any news on this build? I thought I was spoiled by having a jeep given to me ( graduated highschool and got a scholarship)
