The State permit requires is a fishing permit with outer beach access. You to have fishing equipment. And also requires at least one person actively fishing. Not sure how much that is enforced though.

Last I heard...the permit is only available up until April 30th. However, with Robert Moses being closed since Sandy, they might have changed that date. I think the only way to get the permit is to into a state park.

As for Smith's point....when they refer to Outer Beach, are you talking all the way out to the inlet? The birds do their nesting every year, but there is still plenty of beach to drive and setup some chairs and blankets.

i know they usually do bird nesting annualy, but the lady at the office told me that they were going to be closed til mid august. She didnt specify a section, so im assuming that it's all closed

and i know its typically a "fishing" permit, but to anyone that has been is there plenty of beach and possibly some light trails like at smithpoint?
